2. Any law that abrogates or abridges fundamental rights would be violative of the basic structure doctrine
Which among the above statements is / are correct?
Neither 1 nor 2 are correct. First statement is incorrect because fundamental rights can be extinguished as in done in case of right to property. Second statement is incorrect because any law which abridges the fundamental rights does not violates the basic structure of constitution.
